DISASTER #DITCHTHEDiY CONTEST WITH HARDING’S

FULL RULES & REGULATIONS

This is an online contest only. No purchase necessary: Commencing on or about April 6, 2021, Harding’s Services Inc. ( “HSI” ) will be offering its online “#DitchtheDiY Contest”. Harding’s Services Inc. will produce various promotional materials advertising how to enter the contest online at www.hardingsservices.com.

1. HOW TO ENTER: To enter, complete the online entry form on our contest tab on our on our website at https://hardingsservices.com/ditchthediy-contest-rules/  before the contest closing date of Monday, September 6, 2021 at 5 p.m. (MST) and submit a story and attach a photo (digital file). Digital entries must be original, neither previously published nor having won any other award. There is no restriction on when the photo was taken. Photos must be submitted in .jpg, .png or .gif format. Each photo must be less than 1 MB (1 000 KB) in size.

Content alteration of digital files is not acceptable; tonal, cropping, red eye removal and adjustment of contrast, brightness or colour are acceptable. Photographs may be in colour, sepia, or black and white.

Model releases are the responsibility of the entrant and must be available for each person featured in a photograph in the event the photograph is chosen as a winner. Winning entrants must sign a waiver indicating that the photograph is completely original, was taken by them, does not infringe any third-party rights and has not been previously published. Each entry must include entrant’s name, e-mail address, telephone number and location where the photograph was taken. Entries not meeting these requirements will not be eligible for judging. All entries become the property of Harding’s Services Inc. and are subject to use according to our discretion. Winning entrants will be required to sign a copyright assignment and waiver of moral rights.

HSI reserves the right to reject and disqualify any entry which HSI, in its sole discretion, determines to be inconsistent with its reputation. Harding’s Services Inc., or Harding’s – Your Improvement Company, Sherwin Williams ( “Sponsor” ) and Brown’s Social House ( “Sponsor” ) assumes no responsibility for entries it is unable to process due to network, hardware or other technical failures or lost entries.

Multiple entries (digital files) allowed, however, only one digital file allowed per entry form.

2. PRIZES AND APPROXIMATE RETAIL VALUE: One (1) Grand Prize will be awarded. Grand Prize winner will receive one (1) $2,500.00 contribution from HSI towards a project requiring either of the following or a combination of painting, cleaning, handyman services, renovation, epoxy flooring or repair of the aforementioned by HSI.

4. ELIGIBILITY:  This contest is open to all residents of Calgary, Alberta and its surrounding bedroom communities who have reached the age of 18 in the province in which they reside and who are not an employee of, or domiciled with, an employee of Harding’s Services Inc or Harding’s – Your Improvement Company, Sherwin Williams (“Sponsor”), Brown’s Social House  (“Sponsor”) their franchisees, affiliates, subsidiaries, or their advertising and promotion agencies. The winner must be able to participate actively in the project to be completed and allow photo’s and filming of the project as outlined in the general conditions. The winner must be the titled property owner. The winner agrees that the Grand Prize may not equate to the entire project cost and must agree to the project estimate prior to HSI commencing the project.

4. WINNER SELECTION:

On or about September 7th, 2021 in Calgary, Alberta at approximately 3 p.m. (MST), one (1) #DitchtheDiY Contest Grand Prize winner will be selected from entries received from the online database of entries. The winner will be selected based on quality, composition and creativity of the submitted image and story as judged by HIS. The winner’s photos will then be posted (subject to HSI’s sole discretion) on www.hardingsservices.com . The odds of winning depend on the number and quality of eligible entries received.

The selected entrants will be contacted by phone or email. If a selected entrant cannot be contacted within fourteen (14) days of selection or if there is a return of any notification as undeliverable, that entrant will be disqualified and an alternate entrant will be chosen from among the remaining eligible entries. Before being declared a winner, the selected entrants (or the parent/legal guardian of the selected entrant under the legal age of majority) must first:

a) sign a standard declaration and release form confirming compliance with the contest rules, acceptance of the prize as awarded, assigning copyright in his/her photograph and releasing the Sponsor, its advertising and promotion agencies, the contest judges and their respective officers, directors, agents, representatives, successors and assigns (the “Releasees”) from any liability in connection with this contest, the entrant’s participation therein and/or the awarding and use of the prize or any portion thereof. If a selected entrant cannot be contacted by email or telephone or fails to return the contest documents within the specified time, he/she will forfeit the prize and an alternate eligible entrant may be selected.

The Grand Prize details will be put into a “Grand Prize Winner’s Certificate” that will include the $2,500.00 Grand Prize Package and will be delivered to the winner via Canada Post. Prizes must be accepted as awarded. No substitutions except at HSI option. No cash equivalent will be issued to prize winners.

5. GENERAL CONDITIONS:

By entering the contest, each selected entrant agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the contest and/or photograph or other likeness without further compensation, in any publicity or advertising carried out by the Sponsor in any manner whatsoever, including print, broadcast or on the Internet.

HSI and the Sponsor(s), its advertising and promotion agencies and the contest judges will not be liable for any failure of the web site during the contest; for any technical malfunction or other problems relating to telephone network or lines, computer online systems, servers, access providers, computer equipment or software; for the failure of any entry to be received by HIS or  the Sponsor(s), its advertising and promotion agencies or the contest judges for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any web site; or any combination of the above.  Further, HSI or the Sponsor(s), its advertising and promotion agencies, prize partners and the contest judges, will not be liable for any injury or damage to an entrant’s, or any other person’s, computer related to or resulting from participating or downloading any material in the contest. HSI  or the Sponsor, its advertising and promotion agencies and the contest judges are not responsible for late, lost, misdirected, delayed, incomplete or illegible entries or other contest related communications.

HSI and the Sponsor(s) reserves the right to withdraw or amend this contest at any time without prior notice, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this contest as contemplated by these Rules.  Any attempt to deliberately damage any web site or to undermine the legitimate operation of this contest is a violation of criminal and civil laws and should such an attempt be made, HSI and the Sponsor(s) reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

This contest is subject to all applicable federal, provincial and municipal laws. Void where prohibited by law.  The decisions of the contest judges, with respect to all aspects of this contest, are final and binding on all entrants without right of appeal.

In the event of a dispute, online entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry.  “Authorized account holder” is defined as the person who is assigned an email address by an Internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.  If the identity of an online entrant is disputed, the authorized account holder associated with the email account at the time of entry will be deemed to be the entrant.  A selected entrant may be required to provide proof that he/she is the authorized account holder of the email address associated with the selected entry.  The sole determinant of the time for the purposes of a valid online entry in this contest will be the contest server machine(s).

HSI and the Sponsor(s) reserves the right to cancel, amend or suspend this contest without prior notice or obligation in the event of any accident, printing, administrative, or other error of any kind relating to or affecting the contest.

By entering this contest, each entrant expressly consents to the Sponsor(s), its agents and/or representatives, storing, sharing and using the personal information submitted with their entry only for the purpose of administering the contest and in accordance with the HSI’s  Privacy Policy unless the entrant otherwise agrees.  If you opt in to receive further information from the Sponsor(s), your personal information may also be used to contact you in the future regarding other promotions, events or products that may be of interest to you. You may opt out of such contact, meaning you can ask HSI to no longer send you emails. Every email that HSI sends you will detail how you may opt out of being contacted. Your personal information will not be distributed, sold or rented to any third parties by Harding’s Services Inc., Harding’s – Your Improvement Company or the Sponsor(s).
